About the Role

The Senior Compliance Manager will provide day-to-day advice, assistance and guidance to the Cayman Islands based members of the Compliance team in relation to Maples and Calder (Cayman) LLP and Maples Corporate Services Limited. Supported by the Compliance teams in the Cayman Islands and Leeds (UK), the Senior Compliance Manager will support efforts to ensure that the Maples Group is at all times compliant with the provisions of relevant financial services legislation in the Cayman Islands.

Primary responsibilities include:

Regulatory Compliance

Assist the DHOC - Caribbean in ensuring that the Maples Group is at all times duly authorised to carry out the financial services in accordance with the relevant regulations, including the AMLRs, POCA, the Terrorism Act, the Proliferation Financing (Prohibition) Act, and all associated regulatory instruments issued by CIMA

Possess the authority to oversee the effectiveness of the AML/CFT/CPF and sanctions systems and ensure compliance with applicable obligations, operating independently of the business and operational functions overseen to ensure objective and unbiased assessment of the compliance programme

Maintain direct access to senior management and ensure that they are kept informed of the operations of the Compliance Programme, including escalating any ML/TF/PF or sanctions issues as appropriate

Compliance and Risk Management

Investigate negative news findings and determine whether further escalation is required

Analyse and prepare Business Relationship Review Memos, which may be required from time to time

Review any New Business Conflict, Sanctions exposure and any other escalations which may be required from time to time

Assess all business that has been declined to determine whether further reporting obligations are required with any required reporting submitted to the MLRO

Assume primary responsibility for maintenance of the declined business log, register of Politically Exposed Persons (including family members and close associates), Competent Authority requests, transaction alerts, and sanctions monitoring records with any required reporting submitted to the MLRO

Review, assess, and provide senior management approval for all high-risk matters which are escalated by the team

Provide senior management approval for relationships with exposure to politically exposed persons

Assume primary responsibility for the completion of regulatory returns for review and approval by the DHOC – Caribbean and/or HOC – Caribbean

Review, assess and respond to email correspondence received from various stakeholders in a timely manner

Utilise internal systems and tools proficiently and be able to provide training and guidance to others within the team

Develop, maintain and update our compliance systems, controls, policies and procedures, including AML, sanctions and compliance related manuals, ensuring that documentation clearly demonstrates compliance for countering ML/TF/PF

Ensure the compliance monitoring programme is carried out and ViClarity is maintained with current obligations and that all assigned requirements are completed as per the schedule outlined in ViClarity

Co-ordinate oversight of the KYC process with the Compliance Business Partners to ensure clients are onboarded in accordance with policies and procedures

Conduct initial sanctions analysis and documentation in accordance with the Group Sanctions Policy

Ensure sufficient escalation to relevant stakeholders where there may be non-compliant matters and see through to compliant status or off boarding, where may be required

Identify process improvement efficiencies and lead change management projects to continuously improve compliance processes

Design and deliver training materials at all levels for the compliance team and other internal stakeholders

Lead in the implementation of our risk assessment programme to identify, assess and mitigate ML/TF/PF risks in relation to customer types, geographic areas, products and services, and delivery channels, incorporating findings from the Cayman Islands National Risk Assessment

Ensure that CDD, EDD and SDD procedures are established, documented and applied in accordance with the AMLRs and the Rule, including verification of customer identity, beneficial ownership, and ongoing monitoring of business relationships

Oversee sanctions screening and compliance, including screening against UN, UK, Cayman Islands regimes, Targeted Financial Sanctions, and proliferation financing risk mitigation measures

Ensure that any outsourcing of the Compliance Programme or its components is subject to appropriate risk assessment and due diligence, does not impair the ability to meet AML/CFT/CPF obligations, and that the relevant regulatory authorities are notified of any material outsourcing arrangements

Ensure that all necessary transaction records, identification data, account files, business correspondence and CDD documentation are maintained for at least five (5) years after the end of a business relationship or completion of a one-off transaction, and are readily available to the relevant regulatory authorities upon request

Reporting and Documentation

Review monthly KYC and Compliance reports; interpreting data, analysing results and ensuring data accuracy and facilitate any necessary projects to ensure compliance with current standards

Deliver monthly reports to the DHOC on regulatory and industry compliance developments, summary of internal compliance matters, and summary of training positions on a monthly basis using group reporting template

Ensure that the documented risk-based approach, including implementation and monitoring procedures and updates, is maintained and available to the relevant authorities upon request

Audits and Inspections

Provide support to the HOCs during the regulatory inspection process

Assist the Internal Audit team with any scheduled audits

Assist the Quality Assurance Manager with addressing findings, if any, from quality assurance testing

Conduct periodic gap analyses on regulations and regulatory measures to ensure policies and procedures align to regulatory requirements

Ensure compliance with policies, procedures, systems and controls to enable the necessary reports to be provided to the regulator as specified, draft such reports for HOC review prior to submission and ensure reports are filed in a timely manner

Assist the HOC, where requested, in reviewing the compliance manuals and matrices to ensure they continue to meet the requirements of the regulator and where different but not in conflict, the Maples Group compliance requirements

Support the establishment and maintenance of an independent audit function to review and test the Compliance Programme, ensuring its adequacy, effectiveness and alignment with applicable legislative and regulatory obligations, and ensure the audit report is filed with the Authority by the prescribed deadline

Relationship Management

Develop effective relationships with internal and external stakeholders

Liaise with external auditors as may be required

In collaboration with Compliance leadership, lead initiatives that build trust, employee engagement and workforce productivity

Provide leadership support to the compliance team and support their achievement to meeting established KPIs

Advise on appropriateness of client relationships from a regulatory, risk and compliance lens

People Management

Identify training topics and develop and arrange for training to the relevant compliance team on KYC, group procedures, clients/structures or services or on any other topic as relevant

Lead in the performance lifecycle management for the team; identifying training needs and partnering with HR stakeholders and HOCs to deliver on the process

Develop trusting relationships with direct reports, providing real-time coaching and mentoring, and technical advice

Provide coverage for team members as may be required

Manage and develop the client onboarding compliance team members and Compliance Business Partners and provide sufficient guidance and support for their professional development and success

Participate in annual budget planning / workforce forecasting process with business managers

Complete other duties as may be reasonably requested from time to time by the CCO, HOC, or other representatives of the Maples Group

What You Bring

In addition to indisputably high ethical standards and autonomy, the ideal candidate possesses the following as a minimum:

8 or more years of experience, working in legal services or professional services

Is suitably qualified and experienced to sufficiently pass a fit and proper assessment as expected of a senior management role of a regulated entity to the expectations of our regulatory authorities

Education to Bachelor's degree level or equivalent in a management or business discipline

Additional certifications such as CAMS or ICA are highly desirable

An advanced understanding of KYC, AML, CFT, CPF regulatory obligations and sanctions-evasion risks, including knowledge of emerging issues, trends and typologies relevant to the FSP’s business sector

A sound understanding of our business model, activities, products, services, functions, and structure

Familiarity with the Cayman Islands AML/CFT/CPF Framework, including the Proceeds of Crime Act, AML Regulations, Terrorism Act, Proliferation Financing (Prohibition) Act, and associated regulatory instruments

Advanced analytics skills, with strong attention to detail and advanced experience in Excel, Word and PowerPoint

Advanced professional writing skills, in addition to strong presentation and facilitator experience

Strong organizational skills with proven experience working within time constraints and deadlines

Strong team player, with prior people management and leadership experience leading large teams. Cross jurisdictional team leadership experience is desirable.

Be an effective communicator and confident in client interactions

Ability to exercise independent and objective judgment on compliance matters, free from the influence of business and operational functions

Experience in conducting or overseeing enterprise-wide ML/TF/PF risk assessments and implementing a risk-based approach to compliance

Due to the team being multi-jurisdictional, the Senior Compliance Manager must be able to travel to the UK or other countries within the Maples Group as may be required from time to time.
